Євге́н Володи́мирович Во́лох (англ. Eugene Volokh,[2] рос. Евге́ний Влади́мирович Во́лох; 29 лютого 1968 р., м. Київ, УРСР) — американський вчений українського походження, викладач права на юридичному факультеті Каліфорнійського універстиету в Лос-Анджелесі (UCLA), експерт з Першої поправки до Конституції США, законодавства з питань кібер-простору, харасменту та контролю над зброєю в США[3]. Перший бенефіціар іменної професорської стипендії Гарі Т. Шварца для викладачів права на юридичному факультеті UCLA[4]. Засновник та співавтор юридичного блогу "Змова Волоха" (англ. The Volokh Conspiracy). Академічний радник юридичної фірми Mayer Brown.[5]

Дитинство, освіта та викладацька діяльність

Volokh was born in Kiev, Ukraine, then part of the Soviet Union. He emigrated with his family to the United States at the age of seven. At the age of 12, he began working as a computer programmer. Three years later, he received a Bachelor of Science degree in Math and Computer Science from UCLA. As a junior at UCLA, he earned $480 a week as a programmer for 20th Century Fox.[6] During this period, his achievements were featured in an episode of OMNI: The New Frontier, a television series hosted by Peter Ustinov.[7]

In 1992, Volokh received a Juris Doctor degree from the UCLA School of Law. He was a law clerk for Judge Alex Kozinski of the Ninth Circuit Court of Appeals and later for Justice Sandra Day O'Connor of the U.S. Supreme Court. Since finishing his clerkships, he has been on the faculty for the UCLA School of Law where he is the Gary T. Schwartz Professor of Law.

Volokh supported former Tennessee Senator Fred Thompson in the 2008 presidential election, saying Thompson had good instincts on legal issues and that he preferred Thompson's positions on the First Amendment and political speech to McCain's sponsorship of campaign finance reform. Volokh also liked Thompson's position in favor of individual gun ownership.[8] Volokh also noted that Thompson "takes federalism seriously, and he seems to have a fairly deep-seated sense that there is a real difference between state and federal power."[8]

Volokh is noted for his scholarship on the First and Second Amendments to the United States Constitution, as well as on copyright law. His article, "The Commonplace Second Amendment"[9] was cited by Supreme Court Justice Antonin Scalia's majority opinion in the landmark Second Amendment case of District of Columbia v. Heller.[10] He advocates campus speech rights and religious freedom, and opposes racial preferences, having worked as a legal advisor to California's Proposition 209 campaign. He is a critic of what he sees as the overly broad operation of American workplace harassment laws, including those relating to sexual harassment.

Volokh's non-academic work has been published in The Wall Street Journal, Los Angeles Times, The New York Times, Slate, and other publications. Since May 2005 he has been a contributing blogger at The Huffington Post.

On his weblog, Volokh addresses a wide variety of issues, with a focus on politics and law.

The Volokh Conspiracy is a blog, founded in 2002,[11] which covers mostly (but not exclusively) United States legal and political issues,[12][13][14] generally from a libertarian or conservative perspective.[джерело?] In 2008, it was one of the most widely read legal blogs in the United States.[11] The Volokh Conspiracy then had more than one million page views each month. In 2007, Inside Higher Ed wrote that it "probably has more influence in the field – and more direct impact – than most law reviews."[11]

As of 2011, the Volokh Conspiracy was the most-visited academic blog published by law professors[15] and gets an average of approximately 25,000 unique visitors on weekdays. In January 2014, it began an affiliation with The Washington Post.

The Volokh Conspiracy has been cited by the traditional media such as the New York Times[джерело?] and was credited as having influenced an ultimately unsuccessful constitutional challenge to the Patient Protection and Affordable Care Act.[16] The Volokh Conspiracy is one of the blogs that is in the ABA Journal's Blawg 100 Hall of Fame.[17]

In a parody of obscure, unfair, or legally unenforceable Terms and Conditions and the theory that violating these when accessing a website is a criminal offense, the blog has claimed since 2008 that it is not to be accessed by anyone with the middle name Ralph or anyone who has ever visited Alaska.[18]

In January 2014, the Volokh Conspiracy has migrated to the Washington Post as part of an attempt to reach a larger audience.[17] In June 2014, the blog will be behind a paywall.[17]
